These Terms of Service ("Terms") form a binding agreement between you and ArchBlizz AI ("ArchBlizz", "we", "our", "us"). By accessing or using https://www.archblizz.tech, our applications, APIs, and related services (collectively, the "Service"), you agree to these Terms.

If you do not agree, do not use the Service.

1. Eligibility and Accounts

You must be legally able to enter into this agreement and provide accurate registration information. You are responsible for all activity under your account and for safeguarding your credentials. Notify us promptly if you suspect unauthorized access.

2. Plans, Billing, and Credits

Some features may require a paid plan, usage-based charges, or credits. Pricing, quotas, and plan features may change over time.

• If you purchase a subscription, you authorize us or our billing providers to charge your selected payment method.
• Unless otherwise stated, subscriptions renew automatically until canceled.
• You are responsible for applicable taxes, payment disputes, and maintaining valid payment information.
• Promotional credits may expire and may not be redeemable for cash unless required by law.

3. Acceptable Use

You agree not to:

• Use the Service for unlawful, harmful, abusive, or fraudulent conduct.
• Attempt to bypass security controls, limits, or access restrictions.
• Upload malware or interfere with system integrity or availability.
• Violate intellectual property, privacy, publicity, or other legal rights.
• Use automated methods to scrape, reverse engineer, or exploit the Service.

4. Your Content and Permissions

You retain ownership of the content you submit to the Service, including prompts, files, and project assets ("User Content"), subject to rights needed for us to operate and improve the Service.

You grant ArchBlizz a non-exclusive, worldwide license to host, process, transmit, and display User Content solely to provide the Service, enforce these Terms, and maintain platform safety.

5. AI Outputs and Professional Use

AI outputs can be probabilistic, incomplete, or inaccurate. You are responsible for reviewing outputs before relying on them for design, legal, commercial, financial, medical, engineering, or safety-critical purposes.

ArchBlizz does not guarantee uniqueness, non-infringement, or fitness of generated outputs for your specific use case.

6. Collaboration and Public Sharing

If you share projects, invite collaborators, or publish profile links, you are responsible for ensuring you have rights to share that content and for managing access permissions appropriately.

7. Third-Party Services and Integrations

The Service may integrate with third-party platforms (for example, Google Drive). By connecting integrations, you authorize us to perform actions you initiate within granted scopes.

Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party availability, changes, or independent practices.

8. Intellectual Property

Except for your User Content and rights expressly granted to you, all rights in the Service, including software, branding, design, and platform content, are owned by ArchBlizz or its licensors.

9. Feedback

If you submit ideas, feedback, or suggestions, you grant us a royalty-free, perpetual, irrevocable, and sublicensable right to use them without restriction or compensation.

10. Suspension and Termination

We may suspend or terminate access if we believe your use violates these Terms, threatens security, creates legal risk, or harms users or the platform.

You may stop using the Service at any time. Provisions that by nature should survive termination remain in effect.

11. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or completely secure at all times.

12. Limitation of Liability

To the fullest extent permitted by law, ArchBlizz and its affiliates are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business interruption arising from or related to use of the Service.

Where liability cannot be excluded, our total liability is limited to the greater of amounts paid by you to ArchBlizz in the prior 12 months or USD $100.

13. Indemnification

You agree to defend, indemnify, and hold harmless ArchBlizz and its affiliates from claims, liabilities, damages, and costs arising from your use of the Service, your User Content, or your violation of these Terms or applicable law.

14. Governing Law and Disputes

These Terms are governed by applicable laws of the jurisdiction in which ArchBlizz operates, without regard to conflict-of-law principles. You agree to the exclusive venue and jurisdiction of competent courts in that jurisdiction, unless mandatory law requires otherwise.

15. Changes to the Terms

We may revise these Terms from time to time. Material updates are effective when posted (or as otherwise required by law). Continued use of the Service after updates means you accept the revised Terms.
